In plain English
- Pulseri is for businesses. You must be signing up for work, not for personal use.
- The data you put in Pulseri is yours. You are responsible for having the right to use it, including the right to email the people you survey.
- Every self-serve plan starts with a 14-day free trial unless you choose to pay straight away. Each card can start one trial. Your card is charged when the trial ends unless you cancel first, and your plan then renews automatically. See Billing and cancellation.
- We use your data only to run the Service for you. We do not sell it and we do not use it to train AI models (sections 6 and 9). Our Privacy Policy and Data Processing Addendum explain how we handle it.
- On every plan, AI tags written survey answers and writes weekly summaries. It cannot be switched off (section 9).
- We work hard to keep the Service running, but we do not promise a fixed uptime. Enterprise customers can agree more in a signed Order Form.
- If you cancel, your account becomes read-only when the paid period ends. We keep your data for at least 90 days, with reminder emails, before deleting it (section 13).
- If a payment fails and stays unpaid, the account becomes read-only after 14 days and is cancelled after 60 more days (Billing page section 6).
- We can suspend accounts that break the rules or do not pay (section 12).
- You cover claims that come from the data you load or how you use the Service. We cover claims that the Service infringes someone's intellectual property (section 16).
- Both sides' liability is limited to the fees for the 12 months before a claim (at least EUR 100), apart from a few things the law does not let us limit (section 15).
- English law applies, and disputes go to the DIFC Courts in Dubai (section 17), unless your signed Order Form says otherwise.
This summary helps you read the terms. The numbered sections below are the agreement.
1. Who we are and what these terms cover
1.1 "Pulseri", "we", "us" and "our" mean STAFFINGG L.L.C-FZ, a company registered in the Meydan Free Zone, Dubai, United Arab Emirates, with its registered address at Meydan Grandstand, 6th floor, Meydan Road, Nad Al Sheba, Dubai, United Arab Emirates.
1.2 "You" and "your" mean the business or other organisation that creates an account, and anyone who uses the Service for it. The DPA calls you the "Customer".
1.3 These terms cover your use of the Pulseri survey platform, including the dashboard, the API, the assistant (MCP) connection, the JavaScript SDK and in-app widget, and our emails and survey pages (together, the "Service").
1.4 These documents are part of the agreement: these terms; the Acceptable Use Policy; the Billing and cancellation page (the "Billing page"); the Data Processing Addendum (the "DPA"), including the first section of the sub-processors page (the providers that process Customer Personal Data); the plan, price and limit details on the pricing page for the plan you buy; and any Order Form. An "Order Form" is a signed order or agreement between you and us for an Enterprise or other custom plan. The Privacy Policy explains how we handle personal data but is not a contract term.
1.5 If these documents conflict, this order applies, highest first: (a) a signed Order Form; (b) the Standard Contractual Clauses (the EU-approved standard terms for sending personal data abroad, see the DPA), where they apply; (c) the DPA (including that first section of the sub-processors page), for anything about personal data; (d) these terms; (e) the Billing page and the pricing page; (f) the Acceptable Use Policy.
An Order Form cannot change the Standard Contractual Clauses or reduce the protection they give the people whose data is processed.
1.6 Acceptance. You accept these terms, and the documents in 1.4, when you sign up on a page that says that signing up means you agree to them, or when you sign an Order Form that refers to them. The agreement starts at that moment and covers any trial. Where available, we record which version of these terms was shown to you and when (see 18.3).
2. Business use, age and authority
2.1 The Service is for business use only. You confirm that you are not signing up as a consumer. We do not offer the Service to consumers.
2.2 You must be at least 18 years old and able to enter into a binding contract.
2.3 If you sign up for an organisation, you confirm that you have authority to bind it. In that case "you" means the organisation.
3. The Service
3.1 We provide the Service as described on our website and in our documentation, with the plan and limits you choose. Plans, prices, limits and features are shown on the pricing page and in the billing settings of your account. Enterprise plans are agreed with us in an Order Form.
3.2 We may improve, change or remove features. If we remove a feature that is part of your paid plan in a way that materially reduces what you pay for, we will tell you at least 30 days before. You may then cancel, with effect from the date of the removal, and we refund the fees you prepaid for the part of your paid period after that date. We may release beta or preview features. We label them. They are provided as they are and may change or end.
3.3 Availability. We run the Service with reasonable care and skill. We do not promise any particular uptime or response time, and no service credits apply, unless an Order Form says so. We may carry out maintenance and will try to avoid disruption.
3.4 Support. Support is by email at [email protected]. We answer on a reasonable-efforts basis and do not promise a response time unless an Order Form says so.
3.5 Limits. Your plan sets limits, for example how many People you can store and how many surveys you can send each month, by email or in your app. (a) When you reach a limit on how many items of a kind you can have, you cannot create new ones until you remove some or move to a bigger plan. What you already have stays. (b) On self-serve plans, surveys keep sending after you pass your monthly allowance, and the extra sends are charged as overage (Billing page section 4). During a trial, sending stops at the allowance. (c) If you move to a plan that does not include a feature (for example single sign-on or SCIM), that feature is turned off. (d) If you move to a plan that keeps audit log events for a shorter time, older events beyond the new plan's period are deleted after the grace period set out in Billing page section 3.
4. Your account
4.1 Give us accurate information and keep it up to date. Keep your sign-in details, API keys and single sign-on (SSO, signing in through your company's login) and SCIM (automatic syncing of users from your directory) settings secure. You are responsible for what happens under your account, including what your Team Members and any apps you connect do.
4.2 "Team Members" are the people you invite to use your account. You decide their roles and permissions. You must remove people who should no longer have access.
4.3 Tell us promptly at [email protected] if you think your account has been accessed without permission.
4.4 You may not share one login between several people. Machine access should use API keys or service accounts, not a person's login.
5. Plans, trial and payment
5.1 The Billing page sets out the trial, how and when we charge you, overage, taxes, failed payments, cancellation and refunds. It is part of these terms. This section is a short summary; the Billing page has the detail.
5.2 Trial. Every self-serve plan starts with a 14-day free trial unless you choose to pay straight away. A card is needed, and each card can start only one trial. Cancelling during the trial costs nothing. If you do not cancel, the trial ends and we charge your card for the plan you picked (Billing page section 2).
5.3 Charges and plan changes. Prices are in euros. Subscriptions are monthly or yearly, paid in advance, and renew automatically until you cancel. Upgrades apply at once, with a prorated charge for the rest of the period. Downgrades apply at the end of the current period, with no credit for the time left (Billing page section 3). Survey sends beyond your allowance on self-serve plans are charged as overage (Billing page section 4). If you are invoiced under an Order Form, its payment terms apply (Billing page section 9).
5.4 Taxes. Prices do not include VAT or similar taxes. If you are in the EU, you need a valid VAT ID before your first payment. Elsewhere, we add VAT or similar tax where we must charge it (Billing page section 5).
5.5 Price changes. We may change prices for future periods. We will give you at least 30 days' notice by email before a change reaches you. If you do not agree, you may cancel before the change applies to you. The old price keeps applying until the end of the period you have already paid for, and you will not be charged the new price.
5.6 Refunds. Fees are not refundable, except in the cases listed in Billing page section 8. These terms say where a refund applies (sections 3.2, 13.2, 13.6, 14.2, 16.4 and 19.5). Refunds go back to the original payment method.
6. Your data
6.1 You own your data. "Customer Data" means everything you or your Team Members put into the Service or collect through it, including information about People (the individuals you store and survey), survey responses, traits, groups, segments, settings and content. As between you and us, you own it. We claim no ownership.
6.2 Licence to us. You give us a limited licence to host, copy, transmit, display and otherwise process Customer Data only as needed to provide, secure and support the Service for you, and as described in the DPA. We do not sell Customer Data.
6.3 Our roles. For personal data in Customer Data, you are the controller (the one who decides why and how personal data is used) or, if you act for someone else, their processor, and we are your processor (we handle the data on your instructions). The DPA applies. For account, billing and website data about you and your Team Members, we are a controller and the Privacy Policy applies.
6.4 Your responsibilities. You are responsible for Customer Data. In particular you must: (a) have a lawful basis, and give any notices needed, to collect it, to store it in the Service and to contact People by email or in-app message; (b) get any consent the law requires before surveying People, and honour unsubscribes and objections; (c) not put in the Service any data that the Acceptable Use Policy forbids (for example payment card numbers, government identity numbers, or health data), and not ask People to submit them; (d) make sure your use of the Service for employee feedback complies with employment, works council and similar rules that apply to you.
6.5 Aggregated usage data. We may collect technical and usage information about how the Service is used (for example counts of surveys sent and feature use). We may use it, in a form that does not identify you or any individual, to run, secure and improve the Service. We do not use Customer Data to train AI models.
6.6 Deleting a Person and getting your data. You can edit and delete items in the Service. Single survey answers cannot yet be deleted in the Service; we delete or redact them for you on request at [email protected]. (a) When you delete a Person, we remove their name, email address, traits, profile picture and the ID you gave them, and we scrub the events we stored about them. Their survey answers, including written comments, stay in your account so your trend history is not broken. Comments can still contain personal data. If you need specific comments removed, ask us at [email protected]. (b) If the Person's email address was blocked (for example because they unsubscribed), we keep a one-way hash of it (a scrambled code that cannot be turned back into the address), so we never email that address again. (c) You can read your data through the dashboard, the API and the assistant (MCP) connection. We do not offer a bulk export tool. If you need help getting your data out, ask us at [email protected] and we will give reasonable help.
6.7 After your account ends. See section 13.
7. Acceptable use and sanctions
7.1 You must follow the Acceptable Use Policy. We may suspend access if you do not (section 12).
7.2 Sanctions. Each side will follow the sanctions and export control laws that apply to it, and neither side will do anything under this agreement that causes the other to breach them. You confirm that you, and the people who own or control you, are not on a sanctions list of the United Nations, the UAE, the EU, the UK or the US. You will not use the Service from, or make it available in, a country or region under a comprehensive embargo by any of them.
8. Third-party services and integrations
8.1 The Service can connect to services run by others, for example Slack, Microsoft Teams, Zendesk, Stripe, your identity provider, and AI assistants you choose to connect. These are not our services. Their terms and privacy policies apply to your use of them.
8.2 When you connect one, you tell us to exchange data with it. You are responsible for that choice and for making sure you may share the data. We are not responsible for the third party's service, data handling or outages.
8.3 You can disconnect integrations at any time in the dashboard.
9. AI features
9.1 What AI does. On every plan, the Service uses an AI provider to tag written survey answers with sentiment and themes, and to write weekly summaries (digests) of the answers. AI is part of the Service and cannot be switched off for an account.
9.2 What we remove first. Before text is sent to the AI provider, we remove email addresses and some phone number formats from the copy we send. This will not catch everything. Names and other personal details in comments can still reach the provider.
9.3 No training. Our AI provider's terms do not allow it to use the data we send it to train its models. We do not use Customer Data to train AI models.
9.4 Check the output. AI output can be wrong or incomplete. Check it before you rely on it. You can correct sentiment and themes in the dashboard. Do not use AI output as the only basis for a decision that has legal or similarly significant effects on a person.
9.5 Who owns the output. As between you and us, you own the AI output generated from Customer Data (tags, summaries and digests), subject to the rights of others in the underlying content.
9.6 The provider. The AI provider is listed on our sub-processors page and the DPA covers it.
10. Our intellectual property
10.1 We and our licensors own the Service, including the software, design, documentation and trademarks. These terms give you a limited, non-exclusive, non-transferable right to use the Service during your subscription, for your internal business purposes, in line with your plan.
10.2 You may not copy, resell or sublicense the Service, reverse engineer it (except where the law allows this despite this clause), or use it to build a competing product.
10.3 If you give us ideas or suggestions, we may use them without obligation to you. This does not give us any rights in Customer Data.
11. Confidentiality
11.1 Each side may receive confidential information from the other. The receiving side will use it only for the purposes of these terms, protect it with reasonable care, and not disclose it except to people who need to know it and are bound to keep it confidential, or where the law requires. Each side may share the other's confidential information with its own advisers, and Pulseri with its sub-processors, if they are bound by confidentiality.
11.2 The duty lasts during the agreement and for 3 years after it ends. Trade secrets stay protected for as long as they remain trade secrets. We treat Customer Data as your confidential information for as long as we hold it, and the DPA also applies to personal data in it. When the agreement ends, each side will return or delete the other's confidential information on request, except for copies in backups and copies the law requires it to keep. If the law or a court forces a disclosure, the receiving side will tell the other side first where the law allows.
11.3 This section does not cover information that is public through no fault of the receiving side, was already known to it, was independently developed, or was lawfully received from someone else.
12. Suspension
12.1 We may suspend or restrict your account, or part of it, if: you break these terms or the Acceptable Use Policy; your use creates a security risk or may harm other customers or the Service; we must do so by law; or you do not pay (Billing page section 6 sets out the steps for failed payments).
12.2 Where we reasonably can, we will tell you why and give you a chance to fix the problem first. We will lift the suspension once the cause is fixed.
12.3 We do not delete Customer Data because of a suspension. Fees keep running during a suspension caused by your breach or non-payment, but not during one caused by us.
13. Ending the agreement
13.1 You can cancel at any time in the dashboard. Cancellation takes effect at the end of the current billing period or, during a trial, at the end of the trial (Billing page section 7).
13.2 You can end the agreement for cause. If we materially break the agreement and do not fix the problem within 30 days of your written notice, you may end it at once. We then refund the fees you prepaid for the period after the end date.
13.3 We can end the agreement for cause. If you materially break the agreement and do not fix the problem within 30 days of our written notice, we may end it at once. Unpaid fees follow the steps in Billing page section 6 instead: the account becomes read-only after 14 days and is cancelled after a further 60 days. We may end the agreement immediately only if the breach cannot be fixed, if you seriously break the Acceptable Use Policy, or if the law requires it.
13.4 What happens to your data. After your subscription ends, for any reason: (a) your account becomes read-only for at least 90 days. You can still sign in and read your data in the dashboard and through the API, and we will give reasonable help getting your data out if you ask. If we ended the agreement under 13.3 for a serious breach of the Acceptable Use Policy, or because the law requires it, we may withhold dashboard and API access during this time, but we will still give reasonable help getting your data out if you ask; (b) we email you 30, 7 and 1 days before deletion; (c) then we delete your account and Customer Data from our live systems. Copies in backups are gone within 14 days after that. Server logs are kept for up to 30 days; (d) if the law, a court or a legal dispute requires us to keep some data (a "legal hold"), we pause deletion of that data until the hold ends, and then delete it; (e) we keep only limited records: invoices and tax records the law requires us to keep, a record that the deletion took place, and a one-way hash of any card used for a trial, so that it cannot start a second trial.
13.5 What survives. Sections that by their nature should continue after the agreement ends do so. This includes section 5 (for amounts owed), sections 6.1 to 6.6, 9.3, 9.5 and 12.3, the refund duties in 3.2, 13.2, 13.6, 14.2, 16.4 and 19.5, sections 10, 11, 13.4, 14, 15, 16, 17 and 19 of these terms, sections 5, 7 and 8 of the Billing page, and any rights that arose before the end.
13.6 If we stop offering the Service. We may stop offering the Service to all customers, with at least 90 days' notice. In that case we refund the fees you prepaid for the period after the end date.
14. Warranties and disclaimers
14.1 What we promise. We promise that: (a) the Service will perform materially as described in our documentation; (b) we will not materially reduce the features of your paid plan during a period you have paid for, except with notice and a refund under 3.2; and (c) we will provide the Service with reasonable care and skill and in line with the law that applies to us.
14.2 If we break that promise. Tell us. If we do not fix the problem within 30 days of your notice, you may end the agreement by telling us, and we refund the fees you prepaid for the period after the end date.
14.3 Everything else. Apart from 14.1, and as far as the law allows, the Service is provided "as is" and "as available". We do not promise that it will be uninterrupted or error-free, that AI output will be accurate or complete, or that it will meet every need you have.
15. Limits on liability
15.1 Never limited. Nothing in these terms limits or excludes liability for: (a) fraud, wilful misconduct or gross negligence; (b) death or personal injury caused by negligence; (c) either side's duty to pay amounts that are due under this agreement (your fees, our refunds); or (d) anything else the law does not allow to be limited or excluded.
15.2 Losses neither side covers. As far as the law allows, neither side is liable for lost profit, lost revenue, lost savings, loss of goodwill, loss or corruption of data, or indirect or consequential loss, even if told it might happen.
15.3 General cap. As far as the law allows, each side's total liability to the other, for all claims together under or in connection with this agreement, is capped at the greater of: (a) the fees you paid and must pay us for the Service in the 12 months before the first claim arose; and (b) EUR 100.
15.4 These limits apply whatever the claim is based on: breach of contract, negligence or another civil wrong, breach of a legal duty, or anything else. Section 15.1 always takes priority over 15.2 and 15.3.
16. Indemnity
16.1 Your indemnity. You will defend us against claims by a third party that arise from (a) Customer Data or the way you collect or use it, (b) your breach of the Acceptable Use Policy, or (c) your breach of law in using the Service. You will also pay the costs and damages that a court finally awards or that are agreed in settlement.
16.2 For a claim under 16.1, we will tell you promptly about it. You control the defence, but you may not settle in a way that admits fault for us without our consent. We give reasonable help at your cost.
16.3 Our indemnity. We will defend you against claims by a third party that the Service, as we provide it, infringes that party's intellectual property rights. We will pay the costs and damages that a court finally awards or that are agreed in settlement. The process in 16.2 applies the other way round: you tell us promptly, we control the defence and settle only without admitting fault for you, and you give reasonable help at our cost.
16.4 Limits of our indemnity. Section 16.3 does not apply where the claim arises from: (a) Customer Data; (b) changes to the Service not made by us or for us; (c) combining the Service with products, services, data or processes we did not supply, where the claim would not have arisen without the combination; (d) use that these terms do not allow; or (e) AI output (tags, summaries and digests).
If a claim under 16.3 is made, or we think one is likely, we may change the Service so it no longer infringes, or get you a licence to keep using it. If neither is reasonably possible, we may end the affected part of the Service and refund the fees you prepaid for the unused period of that part. Sections 16.3 and 16.4 are your only remedy for third-party claims that the Service infringes intellectual property rights.
16.5 Both indemnities apply on every plan, and both are subject to the cap in 15.3.
17. Governing law and disputes
17.1 Governing law. These terms, and any dispute or claim arising out of or in connection with them (including disputes that are not about the contract itself), are governed by the law of England and Wales.
17.2 Courts. Subject to 17.3, the courts of the Dubai International Financial Centre (the "DIFC Courts") have exclusive jurisdiction, and each side agrees to submit to them.
17.3 Exceptions. These apply to both sides equally: (a) either side may ask any competent court for an urgent order (for example to stop something from happening) while a dispute is decided; (b) either side may go to any competent court to protect its intellectual property or confidential information; (c) if an Order Form names a different law or forum, that applies instead.
17.4 Rights you cannot lose. Nothing in these terms removes rights that the law gives you and that cannot be excluded by contract.
17.5 Talk first. Before starting a claim, each side will first try to settle the matter by writing to the other and talking for at least 30 days. This does not apply to claims under 17.3(a) or (b).
18. Changes to these terms
18.1 We may update these terms. For changes that matter, we will email the account owners at least 30 days before they take effect. Changes that the law requires, or that are needed for security, may take effect sooner, and we will tell you as soon as we can. Other changes (for example fixing typos) may take effect when posted. The date and version at the top show the current version, and past versions are kept in the change log.
18.2 If you object to a change that matters, you may cancel before it takes effect. Your cancellation then takes effect at the end of the period you have already paid for, and the old terms keep applying to you until then. If you do not cancel and keep using the Service after the change takes effect, you accept the new terms.
18.3 Where available, we record which version of these terms was shown to you when you signed up, and the time.
19. General
19.1 Whole agreement. The documents in section 1.4 are the whole agreement about the Service and replace earlier discussions about it.
19.2 Notices. Either side may send notices by email: to us at [email protected], and to you at the email addresses of your account owners. We may also show notices in the dashboard. An email notice counts as received one business day after it is sent. Keep your account owners' email addresses up to date. You do not need a notice to cancel in the dashboard under 13.1.
19.3 Assignment. Neither side may transfer this agreement without the other's written consent, which will not be unreasonably withheld. Either side may transfer it without consent to a successor in a merger or sale of all or most of its business, by telling the other side.
19.4 Severability and waiver. If a part of these terms is unenforceable, the rest still applies, and the part will be replaced by the closest enforceable wording. Waiting to enforce a right does not mean either side gives it up.
19.5 Events beyond our control. Neither side is liable for delay or failure caused by events beyond its reasonable control, such as natural disaster, war, strikes, power or internet failure, or the failure of major infrastructure providers. This does not excuse payment obligations. If such an event stops the Service, or a part of it, for more than 30 days, either side may end the affected Service by notice, and we refund the fees you prepaid for the period after the end date.
19.6 No third-party rights. Only you and we may enforce this agreement.
19.7 Language. The English text is the binding one. If we provide a translation and it differs, the English text wins.
19.8 Contact. [email protected]
