In plain English
- Survey only people who have a reason to expect it from you, and follow anti-spam law.
- Honour unsubscribes, keep bounces and spam complaints low, and do not get around limits with duplicate People or extra accounts.
- Do not survey children under 16 without our written agreement, and do not call an employee survey anonymous: answers are always linked to the person.
- Do not put sensitive data such as card numbers or health data into Pulseri. If it arrives anyway, tell us and we delete or redact it.
- Do not attack, overload or scrape the platform. You may test the security of your own account under the rules in section 6.
- If you break these rules, we may limit or suspend your account, and for serious breaches end the agreement. We usually warn you first.
This policy is part of the Terms of Service. "You" means the customer, its Team Members and anyone else using the Service under its account. Words such as Customer Data, People, Team Members and Service mean what the Terms of Service say they mean. People are the people you survey.
1. Surveying people responsibly
1.1 Send surveys only to people you have a lawful reason to contact. You must have any consent the law requires, and give People any notice the law requires (for example under data protection law).
1.2 Sender rules. Follow anti-spam laws such as the US CAN-SPAM Act, the EU ePrivacy rules, Canada's anti-spam law (CASL) and the UAE's rules on unsolicited electronic messages. In particular:
- say clearly who the survey is from;
- use honest subject lines;
- include a postal address where the law requires one;
- do not add advertising or promotions to a survey without the consent the law requires.
1.3 Unsubscribes. Every survey email has an unsubscribe link. If your email design does not show one, we add one. Do not remove or hide it. If a person has opted out of your surveys through another tool or channel, do not survey them through Pulseri. You can clear an unsubscribe yourself in Pulseri. Do so only if the person has asked to receive your surveys again.
1.4 Bounces and spam complaints. High bounce and complaint rates harm email delivery for every customer. As a guide, we look into an account when hard bounces (emails to addresses that do not exist) are above 5% of a send, or when spam complaints are above 0.1% of the emails it sends over 30 days. We may then pause your email sending, or require you to send from your own verified sending domain, until the cause is fixed. You can clear a bounce yourself once the address has been corrected or confirmed. Only we can clear a spam complaint: ask at [email protected].
1.5 Survey frequency. You choose your own cooldowns and frequency caps in Pulseri. Do not create duplicate People, or use several accounts, to survey the same person more often than those settings or your plan's sending limits allow.
1.6 Do not buy, rent or scrape lists of email addresses and load them into Pulseri.
1.7 Do not use surveys to mislead people: for example, a "survey" that is really an advert, a phishing attempt, or an attempt to collect passwords or payment details.
1.8 Honest results. Do not pressure people to give a certain answer, and do not offer something in return for removing or changing a negative answer. Do not make up or inflate responses, and do not publish scores that you know have been manipulated.
1.9 Review sites. If you ask People to leave a public review (for example by linking to a review site after a survey), follow that review site's rules and consumer law. Many review sites and laws do not allow you to show the review link only to people who gave a high score.
1.10 Employee surveys. Every response in Pulseri is linked to the person who was surveyed, and Team Members who can view responses can see who answered. So:
- do not tell staff that a survey is anonymous;
- call a survey confidential only if you limit who can see individual answers (for example with roles), and keep that promise in reports, exports, alerts and integrations;
- do not use answers to identify or punish people where you promised confidentiality;
- follow employment and data protection law where your staff work.
1.11 Children. Do not survey children under 16 (or a higher age of digital consent where the child lives), and do not put the Pulseri website widget or SDK on websites or apps aimed at children, unless we have agreed to it in writing.
2. What you must not put in Pulseri
2.1 Do not store or ask for:
- payment card numbers, bank account numbers or card security codes;
- passwords or secret keys of other people or systems;
- government identity numbers (for example passport or national ID numbers);
- health information, genetic or biometric data, information about race or ethnic origin, political opinions, religion, trade union membership, sex life or sexual orientation, or criminal records;
- information about children (see 1.11).
2.2 Design questions so they do not invite such information. Free-text answers can still contain it. Comments are sent to our AI provider for tagging and summaries when they arrive. We remove email addresses and some phone number formats first, but this will not catch everything (see the AI section of the Terms of Service). You cannot delete a single answer yourself. If you find such information in an answer, tell us at [email protected] and we will delete or redact it.
3. Illegal and harmful content and conduct
3.1 You must not use the Service to:
- break any law or regulation, or help anyone do so;
- send unlawful, defamatory, harassing, threatening, hateful or discriminatory messages;
- send malware or links to malware, or content that infringes someone's intellectual property or privacy;
- pretend to be another person or organisation, or give a false sender identity, including by using a sending domain you do not control;
- send unsolicited bulk email or messages;
- take part in fraud or other deceptive practices.
3.2 Sanctions. You must not use the Service if you, or anyone who owns or controls you, are on a sanctions list kept by the United Nations, the UAE, the European Union, the United Kingdom or the United States. You must not use it on behalf of such a person, from a country or region under a broad embargo by any of those authorities at the time, or in breach of export control law. We follow the same sanctions laws in providing the Service.
4. Protecting the platform
You must not:
- try to get into accounts, systems or data that are not yours, or test our security, except as allowed in section 6;
- overload or disrupt the Service, or get around plan limits, billing or access controls;
- use several keys, apps or accounts, or duplicate People, to get around rate limits, sending limits, cooldowns, frequency caps or plan limits;
- scrape the dashboard or drive it with bots or scripts. Use the API or a connected assistant instead;
- do anything the Terms of Service forbid about copying, reverse engineering or competing with the Service;
- use automated means to create accounts or trials, or reuse a payment card to obtain repeated trials;
- resell access to the Service itself unless a signed agreement with us allows it;
- use the Service for high-risk activity where failure could cause death, injury or serious damage.
5. API, assistant and integration use
5.1 Keys. Keep API keys, service account keys and assistant connections secret. Do not put secret keys in code that runs in a browser or an app that people can inspect. The public key is only for the Pulseri website widget and SDK. It only sends events from your websites and apps and cannot read your data.
5.2 Rate limits. Stay within the rate limits that apply to you. We may slow or block requests that go beyond them.
5.3 Contractors and agencies. People who work for you, such as contractors or an agency, may use API keys on your behalf. You are responsible for what they do with them.
5.4 Connected assistants. Connect only assistants and apps that you trust, and give them only the access they need. Depending on the access you give, an assistant can read People and survey responses and start real survey sends, for example by activating a campaign. Data an assistant reads leaves Pulseri and is under your control and your terms with that assistant's provider, not ours. Review what an assistant does before it sends surveys to people. You are responsible for what it does with your account's permissions.
5.5 AI. Do not put text in surveys, answers or other content that is meant to make an AI system ignore its instructions or reveal data ("prompt injection"). Do not make decisions with legal or similarly serious effects on a person (for example about their job, pay or credit) based only on AI output from Pulseri, such as tags, sentiment or summaries. Have a person review it.
6. Reporting problems and security testing
6.1 Report misuse of Pulseri, such as spam or phishing sent through it, to [email protected]. Report security vulnerabilities to [email protected].
6.2 You may test the security of your own Pulseri account in good faith if you follow these rules:
- test only your own account and data, and only our own systems, not those of our providers;
- do not run denial-of-service or load tests, and do not send real emails or surveys to people who have not agreed to take part;
- if you reach data that is not yours, stop, do not keep, use or share it, and tell us;
- report what you find to [email protected] promptly, with enough detail for us to reproduce it;
- keep it confidential until we have fixed it or agreed with you that you may share it.
6.3 If you follow these rules, we will not bring legal claims against you for that testing, and we will not treat it as a breach of the Terms of Service or this policy.
7. What we may do
7.1 If we reasonably believe you have broken this policy, we may remove content, pause or block sending, limit features, suspend the account, or end the agreement, as the Terms of Service allow.
7.2 Where we reasonably can, we tell you first and give you a chance to fix the problem. We may act at once where there is a risk of serious harm to People, other customers or the Service, where the law requires it, or where the Service is under attack. We lift a suspension once the cause is fixed.
7.3 We may end the agreement at once for a serious breach of this policy. For other breaches, we end it only if you do not fix the problem within 30 days of our notice.
7.4 Fees continue during a suspension caused by your breach. If we end the agreement because of a serious breach of this policy, we do not refund prepaid fees.
7.5 We may report illegal activity to the authorities.
7.6 We do not routinely review Customer Data. We may review accounts or content where needed to investigate a complaint, a security issue or a suspected breach of this policy, or to meet the law.
8. Changes
We may update this policy. We give at least 30 days' notice of changes that matter, as the Terms of Service explain, and you can cancel before a change takes effect if you do not agree. Changes needed for legal, security or abuse reasons can take effect sooner.
